How an attorney referral works
Call and tell us where things stand. We point you to a licensed New Jersey attorney, a source of free help, or both.
Every attorney we refer you to is independent, and none works for us. You would be their client, not ours, and they set their own fees.
Ask, and we will give you the names of attorneys we have worked with. Before you hire anyone, check the attorney’s license and get the fee agreement in writing. The choice is always yours.
New Jersey foreclosure goes through court
A lender in New Jersey cannot foreclose without filing a lawsuit. It goes to the Superior Court of New Jersey, Chancery Division, General Equity Part, in your county.
When nobody contests, the Office of Foreclosure in Trenton handles the file on the papers, without a judge hearing it.
Each stage, from notice to deed
The general shape of a New Jersey residential foreclosure, in order.

Notice of Intention to Foreclose
Under the Fair Foreclosure Act, a lender generally must send this written notice at least 30 days before filing on a residential mortgage. Keep it and the envelope.

Complaint and summons
The lawsuit is filed and served. The time to respond in writing is commonly 35 days from service.

Contested or uncontested
Uncontested files go to the Office of Foreclosure in Trenton. Contested files go to a county Chancery judge.

The mediation program
New Jersey runs a court foreclosure mediation program for homeowners who qualify. Eligibility depends on timing, so ask early.

Final judgment and writ of execution
The court enters judgment and issues the writ that directs the sheriff to sell.

Sheriff’s sale
The county sheriff runs the sale under procedures and notice set by New Jersey law.

After the sale
A short period, commonly ten days, runs before the sheriff delivers the deed. If your property has been sold, call a licensed New Jersey attorney today.
Contested files commonly take a year or more, and uncontested ones move faster. Foreclosure deadlines are short and firm, and a missed one can be impossible to undo. Go by the dates on your own papers.
When to call a New Jersey attorney
Call a licensed New Jersey attorney now if any of these is true.
- You have a sheriff's sale date scheduled.
- You have been served with a summons and complaint, and the time to respond is running.
- A judgment has been entered against you.
- You have received a writ of execution.
- You have a title problem, an estate, a divorce, or a co-owner dispute alongside the loan.
- Someone has told you that you have a claim against your lender.
- You are thinking about bankruptcy.

Other help for New Jersey homeowners
New Jersey Foreclosure Mediation Assistance. New Jersey runs an assistance line at 888-989-5277.
The New Jersey Housing and Mortgage Finance Agency. It runs free foreclosure counseling programs for homeowners.
Bar association referral services. Your state and county bar associations run lawyer referral services you can call directly.
Legal aid and legal services organizations. These help people who qualify at no cost, and many handle foreclosures. HUD-approved housing counselors can point you to them.
New Jersey licenses foreclosure consultants
New Jersey regulates foreclosure consultants under the Foreclosure Rescue Fraud Prevention Act, N.J.S.A. 46:10B-53 and following. Anyone acting as a foreclosure consultant in New Jersey must hold a license from the New Jersey Department of Banking and Insurance and must post a surety bond before doing any business in the state.

Many states and counties also run free foreclosure prevention programs. We want you to know about them, whether or not you ever hire us.
